Executive Summary

• Service Provisioning: Access to the Optimization Software is provided via tiered subscription models, with premium diagnostic features provisioned immediately upon successful remittance.
• Acceptable Use & Integrity: We strictly enforce an Acceptable Use Policy to protect the integrity of our software ecosystem. Unauthorized circumvention or modification of core modules will result in immediate termination of licensing.
• Financial Terms: All licensing and subscription fees are final and strictly non-refundable.
• Disclaimer of Warranties: The Software is provided on an "as-is" basis, without warranties of uninterrupted functionality across all possible hardware environments.

1. Introduction & Acceptance of Terms

This Master Service Agreement and Terms of Service ("Agreement") governs your access to and use of the proprietary optimization utilities, diagnostic applications, and associated infrastructure (collectively, the "Software") developed, maintained, and distributed by ARGAMING. By initializing, downloading, or executing the Software, you ("Licensee" or "End User") agree to be bound by the stipulations set forth in this Agreement. If you do not consent to these terms, you must immediately cease all use of the Software and remove it from your hardware.

2. Terminology & Definitions

• Software: Any utility, executable binary, analytical framework, or service architecture provided by ARGAMING.
• Licensee: Any individual or corporate entity authorized to access or utilize the Software under this Agreement.
• Service Tier: Refers to the specific licensing level and corresponding access rights granted to the Licensee, such as Basic Access or Premium Licensing.

3. Software License Grant

Subject to your continuous compliance with this Agreement, ARGAMING grants you a limited, non-exclusive, non-transferable, non-sublicensable, and fully revocable license to execute and utilize the Software in object code form only. This license is restricted to personal or internal diagnostic purposes in accordance with the Software's intended optimization functionality. All intellectual property rights remain exclusively with ARGAMING.

4. Restrictions on Use

Under the terms of this license, the Licensee is strictly prohibited from:

• Decompiling, disassembling, reverse-engineering, or attempting to derive the source code or underlying algorithms of the Software.
• Redistributing, encumbering, selling, renting, leasing, sublicensing, or otherwise transferring rights to the Software.
• Bypassing, disabling, or circumventing any digital rights management (DRM), cryptographic signing, or security protocols embedded within the Software.

5. Service Tiers & Billing

Access to the Software is structured across varying service tiers:

• Basic Access (Free Tier): Grants restricted access to standard diagnostic features and limited system usage.
• Premium Licensing (Paid Subscriptions): Unlocks advanced optimization modules, elevated execution privileges, and priority infrastructure access.

The Licensee assumes full responsibility for all financial obligations associated with premium licensing. All remittances are final and non-refundable. ARGAMING reserves the sole right to amend pricing models, feature allocations, and licensing terms at its discretion.

6. License Provisioning

Premium licenses are provisioned and activated automatically upon successful verification of remittance. Upon fulfillment, the Licensee's account profile will be instantly upgraded to reflect the authorized access tier.

7. Security Compliance & Enforcement

To maintain the operational integrity of our ecosystem, we employ active Runtime Application Self-Protection (RASP). ARGAMING retains the right to unilaterally suspend, revoke, or terminate licensing without prior warning if any of the following compliance violations occur:

• Binary Modification: Detection of unauthorized alterations, repackaging, or hash manipulation of the Software binaries.
• Unauthorized Interoperability: Use of unapproved third-party environments or external debugging tools that conflict with the Software's execution.
• Network Interception: Utilizing unauthorized proxies or manipulation to block or alter the Software's telemetry, validation, or secure communication channels.
• Credential Compromise: Sharing, selling, or distributing authenticated account credentials to unauthorized parties.
• Infrastructure Abuse: Actions intended to degrade, stress-test, or maliciously disrupt the backend server architecture.

8. Disclaimer of Warranties

The Software is provided strictly on an "as-is" and "as-available" basis. ARGAMING disclaims all warranties, whether express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Guarantees that the Software will operate uninterrupted, securely, or flawlessly across all device states and firmware versions.
• Liability for any systemic anomalies, data corruption, or hardware instability resulting from the execution of the Software.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ARGAMING shall not be held liable for any indirect, incidental, consequential, special, or exemplary damages arising out of your deployment of the Software. This encompasses, but is not limited to:

• Loss of proprietary data, anticipated revenue, or operational uptime.
• Conflicts arising from the Software's interaction with pre-existing third-party applications or OS-level modifications.
• Security vulnerabilities resulting from the Licensee's failure to adhere to standard cybersecurity protocols.

10. Term and Termination

This Agreement remains effective until terminated by either party. ARGAMING reserves the right to terminate your license and access to the Software immediately if:

• A breach of any material provision within this Agreement is identified.
• The Licensee fails to maintain their financial obligations regarding premium tiers.
• The Software detects attempts to compromise its active security frameworks.

Upon termination, all rights granted to you will immediately cease, and you must securely delete all copies of the Software in your possession.
